Company Rules, Regulations and Code of Conduct

ARTICLE 1 – GENERAL CODE OF CONDUCT

1. General Rules

  • Ensure you look up location and sort out parking deltails in advance to avoid delays.

  • Do not keep valuables or money (except for what you need) in your purse while doing your promotion, leave it in your car. Please keep a minimum in your purse. MM Entertainment and the client are not responsible for lost or stolen items.

  • If you have any expenses while working, please keep the receipts to submit for reimbursement. All expenses must be pre-approved. All receipts incurred must be submitted within the 72 hrs after your shift.

  • MM Entertainment and their clients and affiliates reserve the right to cancel your shift at any time once you are booked with no compensation. Talent work constantly changes and you, as the talent, need to be aware of this.

  • When applying for a position you are then submitted to the client. This does not mean booked. If you are booked, you will receive a full email with all event details, which you must confirm back you have received. If not – MM Entertainment reserves the right to replace you for that booking and remove you from the roster.

2. Role Expectations

  • Remain professional at all times.

  • No chewing gum on the job.

  • No use of your cell phone while on shift or being paid. This can result in non-payment for your shift. Do not promote any other events, companies or brands while you are working

  • No swearing or use of profanity.

  • No smoking on the job, if you have to have a cigarette before you start, please leave enough time to chew a piece of gum before you start.

  • No alcohol or drugs at work, or before work.

  • Be hygienic. Please always use deodorant, and if you feel that you need to bring extra with you.

  • You may be required to lift under 15 lbs on any given shift. This will only be excused with proper documentation.

  • Do not have your significant other attend any of your events.

  • If you do not show up for an event and do not cancel, you forfeit any pay you have owed to you and you will be removed from the roster.

  • You must complete all post event reporting within the deadline. If you miss the deadline, or your post event report is not complete – your shift is not complete and therefore you forfeit your pay.

3. Communication

  • Arrive 20-30 minutes before your performance shift. If you are going to arrive late by chance, please inform your manager. Failure to do so will result in deductions in pay. This is not paid time.

  • You must check in at every gig. Your paid time will begin once your scheduled shift as started and you have checked in with your manager and they have confirmed receipt. If you fail to check in with your program manager, we reserve the right to deduct pay on a 15-minute interval.

  • Always introduce yourself and say goodbye at the end of your shift with your onsite contact or client. You must check in with your onsite contact or client, if you cannot – you need to notify your manager ASAP and introduce yourself by saying “Hello, my name is ___ and I am here on behalf of MM Entertainment”

  • If you have been booked in for an event, and must cancel, please cancel with your manager 24 hours before the event. Make sure you speak with your manager, not just leave a message. A missed shift may result in forfeiting any pay that is owed to you. It is your responsibility to cover your shift off. Failure to do so can result in removal from the roster and forfeit of pay that is owed to you. A missed shift is a shift that you do not show up for and notify MMDM that you will not be attending your shift by speaking with your manager. Do not cancel with your on site contact or the client, it is your manager you must inform.

  • If you do not confirm with your manager the day before your shift, MM Entertainment reserves the right to replace you and remove you from the roster with no compensation.

4. Professionalism

  • Arrive energetic and high spirited when entering location, please leave any problems or conflicts outside of the workspace.

  • If you attend a training/rehearsal session and do not fulfil the job requirements during your scheduled shifts (ie: not show up, or call in sick), you will not be paid for the training.

5. Costumes and Supplies

  • All products, costumes, uniforms, supplies belong to the client and will be deducted from the Independent Contractors pay if not returned in the same state and in a timely manner as outlined in your booking email. All supplies provided to you (uniform, display, etc.) are property of MM Entertainment and its affiliates. They must be returned within good time in the same condition as received in or you will be responsible for replacements costs as well as punitive damages and costs.

  • All training guides and other training and rehearsals are confidential and belong the client. They cannot be shared with anyone not booked for the intended shift. All information, data, plans, specifications, reports, estimates, summaries, photographs and all other documentation prepared by MM Entertainment in connection with the provision of the goods and services under the contract, whether they be in draft or final format, shall be the property of GLDC

ARTICLE 2 – GENERAL APPEARANCE

  • Subject to change: MM Entertaiment reserves the right to change the requirements for a booking to Independent Contractor via the booking email you receive.

  • Keep an open line of communication with your manager. It is important to keep us updated on your look (if you change colour, get a new tattoo or piercing, etc). If you are booked for a job based on your image in the pictures you provide, and you do not resemble your pictures any more – deduction or forfeit of pay may occur. If you misrepresent yourself in any way, we reserve the right to remove you from the roster. You would not be paid for the shift you misrepresented yourself at, and would be responsible for any costs incurred by GLDC and/or its affiliates.

MM Entertainment booking email will always override the stipulations below:

  • Always wear your hair down and stylish for females. For males- clean cut.

  • For females - please bring makeup and anything you need for touch up to your job and keep it in your purse

  • For females - Always put body cream on your body, even if you don’t feel you need it, your skin always looks better.

  • For females - Be prepared for the outfit that they provide not to fit. Bring pins, or simple tank tops that you can wear underneath so you are comfortable.

  • For females - Bring the proper undergarments (if you are expected the change, you might need a strapless bra) and shoes.

  • Please wear the appropriate clothing (dress nicely) to the event, even if you know you are changing.

  • For females - always wear full make up with blush and lipstick. Keep it flattering to your face.

  • Keep your perfume/cologne to a minimum, because some perfumes are overbearing and can be offensive.

  • Remember to shave all areas that will be visible.

  • Wear clothes that fit you and flatter your body type. Nothing baggy.

  • Keep your nails clean and well groomed.

  • You are responsible for providing the correct attire for the weather conditions. If you are working outside, please dress accordingly. Please prepare yourself with any type of protection from the elements including sunscreen.

ARTICLE 3 – GENERAL CONTRACT TERMS AND CONDITIONS

Non-Exclusivity: The awarding of a contract to you as an Independent Contractor shall not be a guarantee of exclusivity. It is MM Entertainment’s intention to utilize you as a Performer for as much work as possible. We reserve the right to remove you off the roster at any time.


Confidentiality: Independent Contractors shall treat as confidential all information which comes to their attention in the course of providing the goods and services and shall not disseminate such information for any reason without the express written permission of MM Entertainment. 


Indemnities: Independent Contractors shall indemnify and save harmless, MM Entertainment and any of its employees, Directors, etc against any losses, liens, charges, claims, demands, suits, proceedings, recoveries and judgements (including legal fees and costs) arising from or related to Independent Contractors performance or non- performance of its obligations, and including or breach of any confidentiality obligations under the contract or infringement, actual or alleged of any Canadian, American or other copyright, moral right, trade-mark, patent, trade secret or other thing with respect to which a right in the nature of intellectual/industrial property exists.

Payment of Independent Contractor: MM Entertainment shall be responsible for the payment of every Independent Contractor engaged, or retained by it for the purpose of assisting it in the performance of its obligations under the contract. Payment will be made 14-30 days after activation date, should the Independent Contractor submit their invoice within the required time period. Independent Contractor invoice must be submitted within 72 hours of shift or loss of payment may occur. Payment can be delayed based on when MM Entertainment is paid by hiring client. MM Entertainment will respond to all payment inquiries within 48 hours of contact. Any receipts incurred must be submitted within this time frame as well. Payment comes in the form of email money transfer. Correct and full mailing and email address must be supplied by Independent Contractor or additional fee per cancelled transaction will be applied. All EMT are subject to a $1.00 administration fee. Payment is issued solely from MM Entertainment. You are not to contact the client or anyone affiliated with the client in regards to booking or payment. Your first point of contact for any reason will always be your manager. If they are not available, you are to contact another member from MM Entertainment. Any contact with the client is to be approved, unless otherwise stated. (For example, cancelling a shift or warning about being late, checking in for a shift, or inquiring about pay.) Independent Contractors are only paid for the time they work. MM Entertainment and our clients reserve the right to cancel or cut shifts as necessary with no compensation to Independent Contractors. All rates are paid out in Canadian dollar; therefore you are applicable for any applicable fees and exchange rates. You have 48 hrs. to dispute discrepancies from a pay sent email.


Non-Compete: The performer agrees that during the term of this agreement and for a period of 1 year following the termination of this agreement, they will not directly or indirectly engage in, solicit, or work with any clients of the Company in any capacity, either as an employee, independent contractor, partner, or in any other capacity, without the prior written consent of the Company.

Exceptions: This non-compete agreement shall not prohibit the performer from performing services for other entertainment companies in the industry, as long as it does not directly involve or lead to the performer working exclusively with the clients of the Company.


Independent Contractor: The relationship of yourself (Independent Contractor) and MM Entertainment is one of owner and independent contractor and not one of employer- employee. Neither is there any intention to create a partnership, joint venture or joint enterprise between yourself (Independent Contractor) and MM Entertainment.


Full Release: Notwithstanding anything to the contrary contained in this Agreement, yourself expressly understands and agrees that in no event shall MM Entertainment, its affiliates, directors, officers, employees, contractors and agents be liable to Independent Contractor or any third party for any direct, indirect, incidental, consequential, punitive, special, personal or exemplary damages, including, without limitation, losses or damages due to service interruptions, damage to computers, data corruption or loss, damages for lost business opportunities, loss of goodwill, business reputation, damage due to software usage, bugs or malware, data inaccuracies, errors or omissions by MM Entertainment, lost data, lost revenue, losses incurred due to business interruption, lost profits or lost business opportunity or any other commercial damages or losses, arising out of or related to this Agreement or any of the services performed pursuant to this Agreement, regardless of the theory of liability. Yourself, Independent Contractor, acknowledges and agrees that in no event shall MM Entertainment, its affiliates, directors, officers, employees, contractors and agents, be liable for any and all work, acts, services, errors, omissions or negligence on the part of MM Entertainment, its affiliates, directors, officers, employees, contractors and agents, in the performance of services pursuant to this Agreement.

Media Release: You may be photographed/ videotaped during your experience by MM Entertainment and/or our Clients, and onsite media. Independent contractors give permission to MM Entertainment, and it’s client’s to use images for the purpose of promoting, training & demonstrating the work of our company through in-house video, images and website, as well as MM Entertainment’s social network, which, includes but is not limited to Facebook, Instagram, YouTube, Twitter.


By becoming part of MM Entertainment  - you agree to the above and this is a binding legal document. If you do not adhere to the above - you have a chance of being removed from the MM Entertainment roster.



Please note: This is a 30-day freelance-binding contract. Every 30 days your contract is automatically renewed once you accept a shift with MM Entertainment. Within those 30 days, all work done for MM Entertainment is one contract, and therefore if you do not follow through to the terms of the contract, you will be removed from the roster.
